Terms of Use
These terms govern your use of the Evolution Zenith website and the services presented on it. The site is an informational and marketing platform: trading itself is executed with the licensed legal entity behind the service you are onboarded to, under the terms confirmed to you during registration. By using the site you accept these terms as written below.
1. Use of the website and services
You may access and use this website and the associated platform services for their intended purpose: learning about the offer, registering an account, configuring analysis tools and managing your activity. You agree to use the services lawfully, with accurate information about yourself, and only if you are of legal age in your jurisdiction. Some functions require completed identity verification; access to them follows our AML and KYC policy. The services are provided to residents of the markets we serve, and using them from a jurisdiction where they are not offered is not permitted.
2. Restrictions
You may not copy the platform's software, reverse engineer its components, resell access to it or use it on behalf of third parties without written agreement. Automated access to the website outside the official interfaces, including scraping at volumes that degrade service for others, is restricted. Each account is personal: credentials are not to be shared, and activity under your account is your responsibility. Where we set operational limits, such as API request rates or plan-based features, working around them rather than asking for a change is a breach of these terms.
3. Promotional materials and information mailings
By registering you consent to receive service-related communications: account notices, security alerts and the updates necessary to operate your account. Marketing emails are sent only with your separate consent, which you can withdraw at any time through the unsubscribe link in every message or in your profile settings. Withdrawal never affects service messages, because those are the ones carrying information you need. Promotional materials describe features and illustrative scenarios; they are not investment advice, and nothing in them binds the platform to any market outcome.
4. Intellectual property
The site's design, texts, graphics, the Evolution Zenith name and logo, and the platform's software are protected by intellectual property rights and remain the property of the platform or its licensors. You receive a limited, revocable right to view and use the site for its intended purpose, and no licence is granted beyond that. Trademarks of exchanges and payment providers referenced on the site belong to their respective owners and appear for identification only, without affiliation or endorsement unless stated.
5. Confidentiality
Information designated confidential or that is evidently confidential by nature, including platform internals shared with you during support, must be kept confidential by you and used only for the purpose it was shared for. Your own data is protected under our Privacy Policy, which describes the categories collected, the purposes and your rights as a data subject. These two obligations run in both directions: we protect what you trust us with, and we expect the same care for what we disclose to you.
6. Links to third-party sites
The site links to third-party resources for convenience, such as exchange websites or payment providers. We do not control those resources, are not responsible for their content or availability, and a link is not an endorsement. Your use of any third-party site is governed by that site's own terms and privacy rules. Verify addresses independently: the only domain on which we ask you to sign in is https://evolution-zenith.org, as described on the Fraud Warning page.
7. Prohibited use
You must not use the site or services to break any law, to infringe intellectual property rights, to transmit spam or malware, to attempt unauthorised access to accounts, systems or data, or to attack the platform's infrastructure through overload, interception or any other means. Using the services for laundering criminal proceeds, sanction evasion or any activity prohibited by our AML policy is strictly forbidden and will be reported where the law requires. Violations may lead to immediate suspension, termination and claims for damages.
8. Support
Support is available at [email protected] during Monday to Friday, 9:00–17:30 CET (excluding public holidays), with the response expectations described on the Contact page. Support covers platform functionality, account matters, billing questions and complaint intake. It does not constitute investment, legal, tax or accounting advice, and staff never make representations about expected market outcomes. Where your question falls outside support's scope, we will say so and point you to the appropriate professional.
9. Warranty disclaimer
The website and services are provided on an "as is" and "as available" basis. While we work to keep information current and systems reliable, we do not warrant that the site will be uninterrupted, error-free, or free of harmful components, nor that all information is complete, accurate or suited to your particular purpose. Market data may be delayed or imprecise, and educational or illustrative content is exactly that. Nothing available on the site constitutes a recommendation or solicitation to buy or sell any asset, and no statement anywhere on it promises profit.
10. Limitation of liability
To the maximum extent permitted by applicable law, Evolution Zenith is not liable for indirect, incidental or consequential damages, including lost profits or trading losses arising from market movements, your configuration choices, third-party service failures, or events of force majeure. Our aggregate liability, where it cannot be excluded, is limited to the direct costs demonstrably caused by our own failure to perform obligations under these terms. Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud or for death or personal injury caused by negligence, and statutory consumer rights in your market remain untouched.
11. Indemnification
You agree to indemnify and hold the platform harmless from claims, losses and reasonable legal costs arising from your breach of these terms, your misuse of the services, or your violation of any law or third-party right. This obligation does not apply where the claim stems from our own misconduct, and it operates alongside, not instead of, the liability rules above. Where an indemnity situation arises, notify us promptly: early notice usually dissolves the matter before it becomes a dispute.
Miscellaneous provisions
If any provision of these terms is found unenforceable, the remainder stays in force, and the unenforceable part is replaced by the closest valid equivalent. Our failure to enforce a right is not a waiver of it. These terms may change; the revised version applies from its publication on this page, and continued use after publication constitutes acceptance. The language of these terms is English, and the relationship is governed by the law applicable to the entity providing the service in your market, without prejudice to mandatory consumer protections.
